The Australian domain namespace has many policies and rules in place to protect its integrity and thus ensure a secure, reliable and trusted .au.
One of the most fundamental policies is that all registrants must have an “Australian presence”. This applies to both individuals and corporate / other entities.
Unfortunately, many legitimate overseas buyers are under the misconception that they can’t acquire Aussie domains because of this.

The easiest way to establish an “Australian presence” for a particular domain name is to apply for an Australian Trade Mark.
This is how our regulator auDA describes it in their Administration Rules:
“the applicant or owner of an Australian Trade Mark can rely upon that application or registration to establish an Australian presence, but only in respect of a domain that is an exact match of the words which are the subject of the Australian Trade Mark;”

Importantly, buyers don’t need to wait for the TM to be approved (which takes ages!). A formal application is sufficient to give a “Pending Trade Mark Owner” status which is sufficient to satisfy our regulator and enable a Change of Registrant to be completed. The newly acquired domain can then be used immediately.
